Application to vary the premises licence Additional documents:
Decision: In reaching its decision, the Licensing Sub-Committee (“LSC”) considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, the Regulations made thereunder, and the Guidance issued by the Secretary of State under S.182 of that Act. In discharging its functions, the LSC did so with a view to promoting the licensing objectives of the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm.
Having considered all written representations, evidence, and oral submissions, the LSC resolved to grant the variation to the Premises Licence subject to conditions.
Permitted Licensable Activities:
Sale and supply of alcohol for consumption off the premises, 24 hours, Monday to Sunday.
The Licence shall be subject to the following conditions:
1. The Premises Licence Holder shall install and operate a CCTV system at the premises, capable of providing coverage of all entry points and areas to which customers have access in any lighting conditions.
2. The CCTV system shall continuously record whilst the premises are open to members of the public, and shall be capable of providing clear images and frontal identification of customers.
3. All CCTV recordings shall be retained for a minimum of thirty-one (31) days and shall be correctly date- & time-stamped; sufficient data storage shall be available to facilitate this.
4. CCTV recordings shall be made available within forty-eight (48) hours upon receipt of a request by the Police and / or an Authorised Officer of the Licensing Authority (as defined by Section 13 of the Licensing Act 2003), and recordings provided in an easily downloadable format.
5. A member of staff shall be present on the premises whilst they are open who is capable of operating the CCTV system and able to facilitate viewing of CCTV footage upon the demand by the Police and / or an Authorised Officer of the Licensing Authority (as defined by Section 13, Licensing Act 2003).
6. The Premises Licence Holder shall perform regular maintenance in accordance with the manufacturer’s guidelines and timeframe as a minimum. All CCTV cameras shall be cleaned and clear of obstructions and signage, including displays and promotional materials.
7. The premises shall perform a test of the CCTV every seven (7) days. This shall include, but not be limited to, confirmation of playback of 31- day old recordings. The testing of the system shall be recorded in a log with the time and date of the test, and name of the staff member completing it, and shall be made available to the Police and / or an Authorised Officer of the Licensing Authority (as defined by Section 13, Licensing Act 2003) upon request. The log shall also include the details of the regular maintenance requirement detailed in Condition 6.
8. In the event of failure or faults with the CCTV which compromise its ability to record clear usable images, real-time playback, or provide recordings in an easily downloadable format, all licensable activity shall cease forthwith. The Chair welcomed all parties and ensured that introductions were made, all papers had been received and all parties were aware of their right to be represented.
The Sub-Committee considered an application made by Everyday Convenience Store for the grant of a premises licence in respect of 1 Malton Street, junction with Swingate Lane, Plumstead Common, London SE18 2EH.
The Licensing Lead Officer gave an illustrated introduction to the report.
In responds to a questions from the LSC the Licensing officer clarified the point he made during his presentation. He stated that is no record of complaints made regarding the operations of the premises. However, the licensing officer added that a police check conducted discovered 3 breaches in the agreed operating schedule, but this issue was subsequently resolve when the police revisited few a days later.
As members had no questions for the licensing officer, they moved directly to receiving an address by the applicant’s agent Darryl Crossman. He informed the LSC that in the absence of the designated premises supervisor, his son Mr Roger Martin will take his place as he has worked with the designated premises supervisor for the last 10 years.
The agent indicated to the LSC that the purpose of this application is to extend the sale of alcohol to 24 hours. He added that together with the applicant, they have engaged the police licensing team and the local police since November 2023 regarding this purpose. He stated that there has been an overview of the premises with the guidance of the above-mentioned authorities and British Licensing. The agent intoned to the LSC that through their engagement they managed to draw up 21 conditions. He explained that these conditions were originally implemented as an operating schedule for the TENs to trial and confirm its effectiveness.
Whiles referencing the 3 breaches in the operation schedule discovered by the police, the agent explained that the breach occurred because f the staff were not of the new conditions. He added that the police confirmed that all the issues were rectified on the next visit thanks to Mr Martin, as he managed to go over the training with the staff. This was done by the manager to ensure all employees are fully aware of what is expected and the new changes.
In highlighting the measures, the applicant would employ to meet the licensing objectives. The agent stated that his client is willing to avoid stocking and selling strong alcoholic beverages. He added this decision is in support of the Councils reduce the strength campaign to curb the availability of cheap and high strength alcoholic beverages in the community. The agent also indicated that the applicant has also agreed and made provision for a 24 hour CCTV system and an incident register. He assured the LSC that these will be checked and be readily available to the relevant authorities on request.
