In reaching its decision, the Sub Committee considered the Council’s statement of Licensing Policy, the Licensing Act 2003, the Regulations made thereunder, and the Guidance issued by the Secretary of State under S.182 of that Act.  In discharging its functions, the Sub Committee did so with a view to promoting the licensing objectives of the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm.


Having considered the application, written and oral submissions, the Licensing Sub-Committee resolved to grant the Premises Licence.


The hours for licensable activities shall be:


Provision of Films: (indoors only)

Monday - Sunday: 08:00 hours until 23:30 hours; 


Provision of Live Music: (indoors only)

Monday – Sunday: 08:00 hours until 23:30 hours;


Provision of Recorded Music: (indoors only)

Monday – Sunday: 08:00 hours until 23:30 hours;


Sale & Supply of Alcohol (On and Off Sales):

Monday – Sunday: 08:00 hours until 00:00 midnight;


Provision of Late Night Refreshment: (indoors only)

Monday – Sunday: 23:00 hours until 00:00 midnight.


The Premises Licence is granted subject to the mandatory conditions for sale of alcohol as set out in the Licensing Act 2003 as amended by the Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010 and Order 2014.


The Premises Licence is granted subject to the following conditions:


1.     Phillip Peters and Katrina Peters shall have no involvement with the premises at any time.


2.     Alcohol sales shall cease 30 minutes before closing time.


3.     Regulated entertainment shall cease one hour before closing time.


4.     Management shall make regular checks outside the premises to ensure that noise from the premises or patrons is not affecting neighbouring residential properties.


5.     Notices shall be prominently displayed at all exits requesting patrons to respect the needs of local residents and leave the premises quietly.


6.     All staff working on a bar or other outlet selling alcohol at the premises shall be trained in the law about the sale of alcohol and must be over 18 years of age.  Such training shall include challenging every individual who appears to be under 25 years of age and to refuse service where individuals cannot produce acceptable means of identification; understanding acceptable forms of ID; and using the refusal log or register.  Such training (including any refresher training) shall be logged and provided not less than every six months.  The training log shall be made available upon request or in any case within 48 hours, for inspection by the Police and authorised persons. (as defined by Section 13 of the Licensing Act 2003)


7.     The “Challenge 25” or “Think 25” proof of age scheme shall be operated on the premises at all times.  All customers who appear under the age of 25 years of age shall be challenged to prove that they are over 18 years of age when attempting to purchase alcohol.  Acceptable forms of ID include a photo driving licence, passport or home office approved identity card  ...  view the full decision text for item 4.
