When determining the application for the Summary Review, the Sub-Committee considered the Council’s Statement of Licensing Policy, the Licensing Act 2003, Regulations made thereunder and the Guidance issued by the Secretary of State under S.182 of that Act. In discharging its statutory function the Sub-Committee did so with a view to promoting the licensing objectives generally and in particular the prevention of crime and disorder.

 

The Sub-Committee gave full and proper regard to the Certificate from the Superintendent of Police that the premises are associated with serious crime.

 

The Sub-Committee considered that the use of the premises to cultivate cannabis, and use of the premises for the distribution of class A drugs is a very serious breach of the licensing objectives, and in particular the prevention of crime and disorder, public safety and prevention of public nuisance.

 

The Sub-Committee were very concerned that it is the Designated Premises Supervisor (DPS) who has been committing serious criminal offences and is therefore not a fit and proper person to be a DPS of licensed premises. The description of the items found upon the premises clearly demonstrate that the premises are very likely associated with the supply of unlawful drugs to patrons and drug dealing.           

 

The Sub-Committee determines that the Interim Steps of the Suspension of the Premises Licence and the immediate removal of removal of the Designated Premises Supervisor from the Premises Licence are appropriate measures to promote the licensing objectives and to prevent further unlawful activity being conducted from the premises.

 

The Interim Steps shall take effect from Mid-day on 9th July 2019   

 

The Premises Licence holder may make representations against the Interim Steps. Upon receipt of any representation against the Interim Steps the Licensing Authority shall convene a hearing within 48 hours.
